PCA MEMBERSHIP TERMS AND CONDITIONS
1) Purpose
a) PCA operates a national directory and professional community for Parenting Coordinators.
b) The Member has completed Parenting Coordination training, or has otherwise been approved by the Directors of PCA & wishes to:
i) be listed on PCA’s public directory; and
ii) participate in PCA membership benefits (including logo use), subject to this Agreement.
2) Term
a) This Agreement starts on the Date and continues for 12 months unless ended earlier under clause 12.
b) Membership renews annually on payment of the renewal fee unless either Party gives 14 days’ written notice before renewal.
3) Membership Benefits
a) Subject to compliance with this Agreement, PCA will provide the Member:
i) a profile listing on PCA’s “Find a Parenting Coordinator” register;
ii) access to member-only communications/resources;
iii) invitations to PCA practice groups;
iv) a limited licence to use the PCA logo as set out in clause 7.
4) Member Eligibility, Qualifications & Warranties
a) The Member warrants that they:
i) have successfully completed Parenting Coordination training;
ii) hold all underlying professional qualifications, registrations, and insurances required for their primary profession; and
iii) have at least 5+ years’ experience in family law/high conflict matters (or as otherwise approved by PCA).
b) The Member must promptly notify PCA if any of the above ceases to be true.
5) Independent Practice
a) The Member sets their own fees, retainer terms, and practice policies. PCA does not supervise or control the Member’s professional work.
6) Directory Listing & Profile Rules
a) PCA will publish the Member’s profile using information supplied by the Member.
b) The Member must ensure all profile information is accurate, current, and not misleading, including:
i) qualifications and professional status;
ii) locations/areas of practice;
iii) services offered, and any stated fees/ranges;
iv) contact details.
c) The Member authorises PCA to edit formatting for consistency, but PCA will not alter meaning without notice.
d) PCA may suspend or remove a listing if:
i) information is inaccurate or misleading;
ii) the Member breaches this Agreement; or
iii) PCA reasonably believes that continued listing may harm PCA’s reputation or the public.
7) PCA Logo License (Contingent Use)
a) Licence: PCA grants the Member a non-exclusive, revocable, non-transferable licence to use the PCA member logo on the Member’s website, marketing, and email signature during the Term only.
b) Conditions of use: The Member must:
i) use the logo only in the form and manner PCA approves;
ii) not imply PCA endorsement/registration/accreditation of their services or any specific service, outcome, or opinion;
iii) immediately cease logo use if membership is suspended or ends, or at the request of PCA; and
iv) comply with PCA brand guidelines (as updated from time to time).
8) Complaints body contingency:
a) PCA is not a complaints-handling body.
b) The Member will hold current professional indemnity insurance for parenting coordination work and a complaints handling body.
c) As PCA is not a complaints-handling body, logo use is conditional on the Member having a clear complaints-handling procedure in their own Parenting Coordination Participation Agreement/Contract, including nomination of the Member’s external complaints/professional disciplinary body (e.g., Resolution Institute or relevant professional regulator).
9) Professional Standards & Conduct
a) The Member must, at all times during the Term:
i) Operate within Court Authority, only act within the scope permitted by any FCFCOA order or written Parenting Coordination agreement
ii) Maintain Australian Professional Standing, keep current registration/accreditation in Australia for the Member’s primary discipline;
iii) Comply with all ethical codes, complaint pathways and disciplinary processes of that body.
iv) Maintain Australian-appropriate Insurance, hold and maintain Professional Indemnity and Public Liability insurance appropriate to Parenting Coordination practice in Australia.
v) Comply with applicable Family Violence & Child Safety, Australian laws and mandatory reporting obligations relating to child protection and family violence;
vi) Implement safety-responsive processes consistent with Australian court expectations.
vii) comply with the Privacy Act 1988 (Cth) and any relevant State/Territory privacy/health records legislation;
viii) Keep accurate records sufficient to justify decisions/recommendations made within scope.
10) Good Standing, Complaints, Notifications & Cooperation
a) The Member must notify PCA promptly if they become aware of:
i) Any criminal charge or conviction;
ii) any formal complaint lodged against them related to Parenting Coordination;
iii) any regulatory investigation, disciplinary action, suspension, or restriction affecting their professional practice.
iv) PCA may request (and the Member will reasonably provide) non-privileged information sufficient for PCA to assess reputational or directory-integrity risks.
v) PCA may suspend membership while a complaint is investigated.
11) Fees & Payment
a) Membership fee: $250 +GST per annum (or as varied on renewal notice).
b) Fees are payable in advance and are non-refundable except where required by law.
c) If payment is overdue by 14 days, PCA may suspend the Member’s listing and logo licence.
12) Suspension & Termination
a) PCA may suspend or terminate membership immediately if the Member:
i) breaches this Agreement and fails to remedy within 7 days of notice;
ii) engages in serious misconduct;
iii) loses required professional registration/insurance;
iv) provides misleading profile information.
b) The Member may terminate by providing 14 days’ written notice.
c) On termination, the Member must:
i) cease using the PCA logo immediately;
ii) remove all logo instances from online materials within 7 days;
iii) stop holding themselves out as a current PCA member.
13) Limitations of PCA Responsibility
a) PCA provides a directory and professional community only.
b) PCA is not liable for:
i) the Member’s clinical/professional decisions;
ii) any client outcomes; or
iii) disputes between the Member and their clients.
14) Intellectual Property
a) PCA retains all rights in PCA branding, website, training, and other materials. No use or reproductions are permitted without the written authority of PCA
b) The Member grants PCA a licence to publish their supplied content for directory purposes during the Term.
15) Privacy
a) Each Party must comply with applicable Australian privacy laws.
b) The Member consents to PCA hosting and displaying their professional contact details and bio publicly.
